IMPORTANT RENTAL INFORMATION

1. Specific Needs: If you have specific needs please be sure to request them. We suggest that you tour or view pictures of the rental property prior to making your reservation as we will be unable to make substitutions (during the peak season) or give refunds after your arrival.

2. Additional Fees: A 4% occupancy tax, 6.75% North Carolina sales tax (reduced to 6.5% on 6/1/07), $85 reservation fee, and $400 security deposit will be charged in addition to the weekly rate. Also see Item 15 Housekeeping/Maintenance Fees below.

3. Methods of Payment: Lake Toxaway Company Rentals accepts personal, company, certified or travelers checks as payment. A 50% deposit is required upon acceptance of a signed lease and the balance of the lease is due 30 days prior to arrival.

4. Minimum Stays: Summer rentals run Saturday to Saturday and require a minimum one-week reservation. Some of our homes are available September-May on a monthly, weekly, or 3 to 4 night minimum. Holidays out of season require a minimum 4-night stay.

5. Occupancy: All homes have a maximum occupancy equivalent to 2 people per bedroom (ex: 4 bedroom home maximum occupancy=8 people) unless otherwise stated in the description of the home. This maximum occupancy is due to septic system limitations outlined by the local and state health departments. Management reserves the right of eviction for unauthorized occupancy. Children under the age of two are not included in the maximum occupancy total.

6. Cancellations: Full refunds less a $85 reservation fee are given on cancellations made at least 90 days prior to the first day of the rental period. Should cancellation be necessary with less than the required notice, advance deposits will be forfeited unless the property is re-rented with no loss of income to the owner.

7. Check-in/Check-out: Check-in and Check-out will be at the Lake Toxaway Company Main Sales and Administrative Office on Highway 64 at Toxaway Falls. Check-in is 4:00 p.m. Check-out is 10:00 a.m. These times are strictly enforced so that our housekeepers have adequate time to prepare the property for the next guest. Office hours June – August are Monday-Friday 8:30 a.m. - 5:00 p.m. and Saturday-Sunday 9:00 a.m.- 5:00 p.m; September – October Monday-Friday 8:30 a.m. – 5:00 p.m. and Saturday 9:00 a.m. – 5:00 p.m.; November – May Monday-Friday 8:30 a.m. – 5:00 p.m.

8. Late and Holiday Arrivals: If arrival is after hours or during a holiday a check-in package including a map and keys to your rental home, temporary membership cards, etc. will be left in the "Late Check-in Box" at the Lake Toxaway Company Main Sales and Administrative Office on Highway 64 at Toxaway Falls.

9. Pets: Pets are not permitted in the homes or on the property unless home is advertised as "pet friendly" and arrangements have been made in advance to accomodate them.

10. Smoking: Smoking is NOT permitted in any of the homes.

11. Telephones: All homes have telephones for the convenience of guests. Local calls are free. A credit card, calling card or third number billing is needed to place long distance calls. Some cell phones do not work well in the area and it is advised to have one of the alternate long distance service abilities listed above during your stay.

12. Internet Usage: Local Internet access is available. All other Internet carrier calls (AOL, Mindspring, etc.) are long distance and therefore inaccessible without this local connection. Local account set-up may be obtained on-line and by calling Citizens Telephone in Brevard, NC 828-885-5577.

13. Temporary Membership Cards: If the home being rented has country club membership a tenant will have the ability to apply for a temporary membership giving access to all club facilities. Lake Toxaway Company - Rentals will mail an application for temporary membership to Tenant when the final rental deposit is received and no later than 30 days prior to arrival. The application must be received by Lake Toxaway Company – Rentals at least 20 days prior to arrival and application will at that time be forwarded to Lake Toxaway Country Club. Tenant will only be notified if membership is denied and no less than 10 days prior to arrival. If Tenant is a temporary member in good standing (having obtained and paid in full memberships to Lake Toxaway Country Club prior), an application will be forwarded with return request so that application can be put on file. Deposits made for rental properties will not be refunded should Lake Toxaway Country Club deny membership. No membership will be unreasonably denied. Tenants renting homes with club membership that obtain pre-approval to use club facilities will be issued a temporary membership card upon arrival. A temporary membership can only be applied for by the person that has signed a Vacation Rental Agreement through Lake Toxaway Company – Rentals for a home with a full membership. Tenant signing Rental Agreement will be responsible for any charges incurred on this account during their stay, and therefore membership number may be issued to and used by others at discretion of Tenant responsible. Tenant will be responsible for all charges applied toward temporary number including but not limited to greens fees, cart rentals, tennis fees, and dining charges. Lake Toxaway Company – Rentals will not divulge temporary membership number to anyone other than Tenant. Additional temporary membership accounts may not be obtained by extended groups that may be staying in homes without a membership as part of group staying in homes with membership. Temporary cards are prepared ahead of time and cannot be issued on Saturdays.

14. Condition of Homes: All rental homes provide the following amenities: Linens for each bed, one set of towels for each person up to the maximum occupants in the home, washer/dryer, dishwasher, microwave, well equipped kitchen, TV/VCR or DVD player, ice maker, telephone, pillows and blankets, coffee maker, dishes, glassware, flatware, cookware, utensils, and either a propane or charcoal grill. One roll of toilet tissue per bathroom, one roll of paper towels, dish soap and dishwasher detergent will be provided upon arrival. The homes are to be left in the same condition they were in upon arrival, normal wear and tear expected. If more than a normal cleaning is required after departure, Tenant will be billed for any additional cleaning that is needed.

15. Housekeeping/Maintenance Fees: Tenant can elect to clean rental property prior to departure and not be charged cleaning/maintenance fee. However, tenant will be responsible for cleaning premises to agency satisfaction and specifications. If tenant elects to clean property tenant must notify agent at least 1 month prior to tenancy at which time agency will forward required cleaning list to tenant. Check-out will remain at 10:00 a.m. and upon departure an inspector will be sent by the home. If at time of inspection it is determined home is not cleaned to agency satisfaction and specifications, home will be cleaned to meet these standards and tenant will be responsible for departure cleaning fee and any additional cleaning fee if home is excessively dirty. If tenant elects not to pay cleaning/maintenance fee prior to arrival, maintenance or cleaning can be provided on a service call basis and tenant will be charged a service call for any services requested or required. These fees can be paid from tenant security deposit, however security deposit is not to be considered a maximum that can be billed for such services.

16. Security Deposit: A security deposit is required to cover, for example, cancellation with less than the required notice, lost keys, unauthorized pets, excessive cleaning and/or damage to the home, and unauthorized use of pay-per-view movies. Please report any damage noted on arrival so that you will not be charged in error. Any breakage or damage occurring during your stay should be reported and arrangements made to cover replacement cost prior to your departure. The security deposit is not intended to be a limitation of liability should damages or charges exceed $400 and does include applicable sales tax.

17. Phone Numbers: Listed on your confirmation and contract is the phone number and address of the home you have rented.

18. Group Check ins: If you have more than one group arriving to check in and need more than one map or set of keys, contact our office and let us know the names of these guests so that a map and/or keys are available when they arrive.

19. What to Bring: We suggest packing and including the following items on your grocery list: Laundry detergent, bath soap and shampoo, toilet tissue, paper towels, napkins, condiments, aluminum foil, plastic wrap, extra towels (for outdoor activities) and face cloths, and hangers.

20. Boats: You CANNOT trailer a boat of any kind to Lake Toxaway. Lake Toxaway Marine offers a full rental fleet of canoes, pontoon, ski, and fishing boats. To reserve a boat during your stay, please contact them at 828-884-6919. Jet skies are not allowed on Lake Toxaway.

21. Grocery Stores: The closest grocery stores and video rental stores are in Brevard (19 miles east of Lake Toxaway) and Cashiers (13 miles west of Lake Toxaway). Most of our guests travel through Brevard or Cashiers to get to Lake Toxaway. If this is the case, you may want to plan on grocery shopping in either of these towns as you drive through, prior to checking in. Guests traveling from the Atlanta area via Highway 11 may want to stop at one of the grocery stores in Seneca, SC (located on Highway 11 about 35 minutes from Lake Toxaway). This will save you the time of having to travel into Brevard or Cashiers after checking in. Keep in mind that check-in is at 4:00 p.m. and we cannot guarantee an earlier check-in time.

22. Advanced Reservations: Reservations are accepted up to one year in advance. Those that are made for a future period for which rates have not been set are considered tentative. Once rates are set, a notice will be sent quoting the new rate and a 50% deposit will be requested.

23. Agency Disclosure: Lake Toxaway Company serves as the agent and representative of all owners of vacation homes in the rental program and is acting in and for the best interests of the owners.

24. Price Changes: All rates quoted are subject to change.

DIRECTIONS TO THE LAKE TOXAWAY COMPANY MAIN SALES AND ADMINISTRATIVE OFFICE FOR CHECK-IN:

Driving west on Highway 64 through Brevard NC, our office is 19 miles from downtown Brevard on Highway 64 on the right, just after crossing the bridge to Toxaway Falls. Look for the green and white signs.

Driving east on Highway 64 from Cashiers/Highlands or 281 South, continue past the main entrance to Lake Toxaway Estates on the left. Our office is on the left on Highway 64, .9 miles past the main entrance. Look for the green and white signs.
